Employers may be required to keep cleaning records of washrooms in the workplace. What You Need to Know

The Ontario Ministry of Labour, Immigration, Training and Skills Development has launched a consultation on a proposed standalone washroom cleaning regulation under the Occupational Health and Safety Act.

This impact stemming from Bill 190 (Working for Workers Five Act, 2024) aims to enhance workplace hygiene standards across the province.

Would be Included in the Proposed Washroom Cleaning Regulation:

The regulation itself has not been proposed, but rather some key ideas are described in the consultation. These include:

Washroom cleaning record on door to women's washroom.

Scope

The regulation would apply to workplaces covered under the Occupational Health and Safety Act (OHSA), including construction, manufacturing, healthcare, mining, hospitality, education, and farming operations.

Record Requirements

Employers and constructors would need to ensure that cleaning records for washroom facilities contained specific details, such as date and time of the last two cleanings.

Posting Options

The record would need to be posted, either physically or electronically (with some additional requirements).

Exceptions

The regulation wouldn’t apply to home offices, off-site work locations, or certain multi-retailer establishments where washrooms are primarily for public use.

Collaboration

In leased or rented workplaces, employers may need to work with landlords or building management to ensure compliance.

This regulation would be contingent on Bill 190, Working for Workers Five Act, passing.

Potential Impacts and Considerations

The Ministry is seeking feedback from the public on several crucial aspects:

  1. Financial impact of implementing the new posting requirements
  2. Estimated time needed to set up compliant systems
  3. Opinions on mandating minimum cleaning frequencies
  4. Suggestions for strengthening the proposed regulation.

Next Steps for Employers

  1. Review the consultation. You can access it below.
  2. Review your current practices: Assess your existing washroom cleaning procedures and record-keeping methods.
  3. Evaluate Implementation Needs: Consider the resources required and responsibilities that need to be assigned so that your company can comply with the proposed regulation.

The consultation closes on October 18, 2024.
